1. About these Terms

These Terms and Conditions govern your use of ezebreathe.com and purchases made through the website. Ezebreathe is operated by Craftek (Pty) Ltd t/a The DB Group, a private company registered in the Republic of South Africa. Full supplier information is available on our Company Information page.

By accessing the website or placing an order, you agree to these Terms. Nothing in these Terms limits any right granted to you under applicable South African law.

2. Website use

You may use this website only for lawful purposes. You may not interfere with its operation or security, attempt unauthorised access, submit false or fraudulent information, misuse its content, or infringe another person’s rights. We may restrict access where we reasonably believe the website is being misused.

3. Product information

Ezebreathe nasal strips are simple, non-medicated, external-use consumer products designed to support nasal airflow during sleep, exercise, travel and everyday activities.

We take reasonable care to describe and display our products accurately. Minor differences in colour, packaging or presentation may occur without materially affecting the product. Individual experiences may vary.

Website content is general information and is not medical advice, diagnosis or treatment. Always follow the supplied application instructions and warnings. Stop use if irritation or discomfort occurs. If you are pregnant, have a medical condition, are purchasing for a child or are unsure whether the product is suitable for you, consult an appropriate healthcare professional.

4. Orders

An order submitted through the website is an offer to purchase the selected products. An electronic acknowledgement confirms that we received the order but does not necessarily mean it has been accepted. An order is accepted once payment has been processed and the order is confirmed for fulfilment.

We may decline or cancel an order where a product is unavailable, payment cannot be verified, incorrect pricing or product information was displayed, fraudulent activity is suspected, or delivery is not reasonably possible. If we cancel a paid order, we will refund the affected amount using the original payment method wherever reasonably possible.

5. Prices and payment

Prices are displayed in South African rand unless stated otherwise. Applicable delivery fees, taxes and other charges will be shown during checkout before payment is completed.

Payments may be processed through Paystack or another payment provider displayed at checkout. The provider’s terms and privacy practices may apply. Ezebreathe does not receive or store your complete card details when payment is handled by an external payment provider.

We may change prices and promotional offers. A change will not affect an order already accepted, except where an obvious pricing error occurred.

6. Promotions and discount codes

Promotions and discount codes apply only during their stated period and may be limited to selected products, customers or order values. They cannot be exchanged for cash or combined unless expressly stated. An offer may be withdrawn or corrected if issued or displayed in error. Specific promotional conditions take priority over this general clause.

7. Delivery

Available delivery destinations, shipping methods and charges are shown during checkout. Delivery timeframes are estimates unless expressly guaranteed. Delays may occur because of couriers, incorrect delivery details, exceptional demand or circumstances outside our reasonable control.

You are responsible for providing accurate contact and delivery information. Please contact us promptly if you notice an error. Nothing in this section limits a consumer’s rights where goods are not delivered within an agreed or reasonable period.

8. Inspection of delivered orders

Please inspect your order after delivery and notify us promptly if the wrong product was delivered, an item is missing, the product or packaging arrived damaged, or you reasonably believe the product is defective. We may request photographs and order information so that we can investigate and resolve the matter.

9. Cancellations, returns and refunds

Returns, replacements and refunds are governed by our separate Refund and Returns Policy, which forms part of these Terms.

Because nasal strips are personal-use hygiene products, opened or used products may not be eligible for return merely because of a change of mind. This does not remove any right you may have where a product is defective, unsafe, incorrectly supplied or otherwise covered by mandatory consumer law. If our policy conflicts with a mandatory right under South African law, the applicable law takes precedence.

10. Customer information and order records

You must provide accurate information when ordering and keep any account credentials secure. Order confirmations and related transaction records are normally sent electronically. Please retain them for your records. You may contact us if you need reasonable assistance accessing an order record available to us.

11. Privacy and cookies

We process personal information in accordance with our Privacy Policy and applicable data-protection legislation, including POPIA. The website may use cookies and similar technologies for essential functionality, analytics, performance measurement and advertising. Where required, optional cookies will be used only after the appropriate consent has been obtained.

12. Intellectual property

The Ezebreathe name, branding, product photographs, graphics, written content and website design are owned by or licensed to Ezebreathe unless stated otherwise. You may view and use the website for personal, non-commercial purposes. You may not reproduce, modify, distribute or commercially exploit its content without prior written permission.

13. Third-party services and links

The website may link to or integrate with payment processors, analytics providers, social-media platforms, delivery providers and other third parties. We are not responsible for third-party websites or services outside our reasonable control. Their own terms and privacy practices may apply.

14. Website availability and errors

We aim to keep the website accurate, secure and available, but uninterrupted or completely error-free operation cannot be guaranteed. We may correct errors, update information, perform maintenance or temporarily suspend parts of the website where reasonably necessary.

15. Liability

To the maximum extent permitted by law, Ezebreathe will not be responsible for indirect or consequential loss that was not reasonably foreseeable. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability arising from gross negligence or any mandatory consumer right. Customers remain responsible for using products according to the supplied instructions and warnings.

16. Changes to these Terms

We may update these Terms to reflect changes to the website, products, business operations or applicable law. Updated Terms will be published on this page with a revised effective date. Changes will not retrospectively remove rights already attached to an accepted order.

17. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. A dispute may be dealt with by a court, consumer-protection body or dispute-resolution forum having lawful jurisdiction. Nothing prevents a consumer from using any complaint or dispute-resolution mechanism available under applicable law.

18. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
